Assessing legal operations and paralegal work

Roles that do the substantive legal work that does not require a lawyer — drafting, document review, bundling, diarising deadlines and case administration.

Paralegals, legal assistants and legal operations staff do the substantive work of a legal matter that does not require a qualified lawyer: drafting and amending documents, reviewing disclosure, preparing bundles and chronologies, managing the deadline diary, handling client correspondence and running the matter's administration. About 40,800 US openings a year are projected across a population that is not growing, which tells you the shape of the market — this is churn-driven hiring into a role where firms are replacing someone who already knew the matters, and the cost of the replacement being wrong is concentrated in the first three months.

The regulatory constraint here is not licensure. BLS notes that paralegals are not required to be licensed, though many employers prefer certification. It is conduct: this family works inside rules on the unauthorised practice of law, professional privilege, conflicts and confidentiality, and it works against court and filing deadlines that are not negotiable. That is what a defensible assessment has to be built around. The interesting thing to test is not whether a candidate can recite that they must not give legal advice — everyone says that — but what they actually do when a client emails asking a question whose honest answer is legal advice, on a Friday, when the fee earner is unreachable. The right behaviour is a specific piece of writing: acknowledge, do not advise, commit to a time, and escalate. It is observable, gradeable, and completely invisible in an interview.

The top quartile is separated by precision and by deadline instinct. A strong paralegal reading a set of documents notices that the executed version differs from the agreed draft in one clause, flags it, and does not silently reconcile it. A strong one handed a court order extracts every date in it, works backwards to the internal deadlines each one implies, and puts them in the diary before doing anything else. The median candidate is competent at the task they were given and does not notice the second-order obligation the document created. Since almost the entire job is documents in and documents out, this is one of the few families where a simulation loses essentially nothing relative to the real work.

Current screening is a CV read weighted heavily on the firm names and practice areas on it, a conversation, and occasionally a request for a writing sample. The writing sample is the closest thing to a real assessment in this family and it is badly broken: it is unsupervised, of unknown authorship, drafted with unlimited time, and usually a document the candidate was proud of rather than a representative one. Comparing two candidates' writing samples tells you which one had a better supervisor. A timed, monitored drafting task from a common brief — same documents, same deadline, same mark scheme — is the same evidence made comparable, and it also surfaces the thing a sample can never show: how the quality holds when the clock is running.

Why this work can be assessed

The output is almost entirely written documents produced to a standard under a deadline, which written-artefact tasks reproduce with very little loss.
